        US Election 2000
Reagan’s judges hold the whip hand today

        By Ben MacIntyre
        The Times, UK
        Monday, December 11, 2000

In one more bizarre twist to the US election, Ronald
Reagan could end up winning the presidency for his fellow
        Republican George W. Bush.

Most of the conservatives on the Supreme Court were
Reagan nominees and if they vote in favour of Mr Bush
after today’s court hearing, the Texas Governor will have
        Mr Reagan to thank.

Three of the five conservatives who voted on Saturday to
stop the recount in Florida and hear the issue were
Reagan appointees and the Chief Justice, William
Rehnquist, was elevated to that job by Mr Reagan in 1986.
The fifth justice on the majority side was Clarence
Thomas, who was appointed by Mr Bush’s father, former
        President Bush.

The divided ruling exposes the deep ideological split
within the Supreme Court and even before hearing the case
the opposing sides attacked one another in language more
        familiar in politics than law.

”The majority has acted unwisely,” Justice John Paul
Stevens declared, writing a dissenting opinion for the
court’s four centre-left justices — Ruth Bader Ginsburg,
David H. Souter, Steven G. Breyer and himself.

The ruling ”cast a cloud on the legitimacy of the
election”, the dissenters said, adding that the decision
to stop the recount was ”tantamount” to a decision in
favour of Mr Bush on the case itself, since it would be
almost impossible to complete the count in the time
        remaining.

Justice Antonin Scalia, a Reagan appointee and the most
outspoken conservative on the court, issued a stinging
statement in response. ”Count first and rule upon
legality afterwards is not a recipe for producing
election results that have the public acceptance
        democratic stability requires,” he declared.

He all but predicted that the outcome of today’s hearing
would be victory for Mr Bush. ”The issuance of the stay
suggests that a majority of the court, while not deciding
the issues presented, believe that the petitioner has a
substantial probability of success,” he said.

The struggle within the court is on a razor-edge. If only
one of the conservative justices swaps sides, the court
could rule by a majority in favour of Mr Gore. Attention
at today’s hearing will focus on the two conservatives
nearest to the centre — Sandra Day O’Connor and Anthony
        Kennedy.

The court managed to preserve a semblance of peace
between the justices earlier in the conflict, ruling
unanimously and anonymously to set aside another Florida
        Supreme Court ruling.

By yesterday, however, any such pretence had evaporated
and when the nine justices meet for their historic
showdown today, the confrontation between Right and Left
        is expected to be acrimonious.

Whatever the final verdict, critics say that by ruling on
what appear to be party lines, the court has done itself
        huge damage.

Today was supposed to be the start of a four-week holiday
for the Supreme Court. Justice Rehnquist usually throws a
party and leads a festive song. Now the justices are more
likely to be grilling than toasting one another.

That’s like saying that the Super Bowl shouldn’t end if the clock runs
out on one team that looks like it MIGHT have scored if given another
    5 or 10 minutes.

The new American whiny slogan. "I need more timmmmmmmmme." It might
    just replace "I’m a vicccctimmmmmmm!"

There are rules. In this case, they are called laws. Liberals don’t
like laws. That’s why so much socialism has been enacted from the
bench. It doesn’t pass Constitutional muster in the proper channels.
